These Terms and Conditions set out the basis on which FE SPORTS AUSTRALIA PTY LTD (“FE Sports”, “we”, “our”, “us”) supplies products to customers located in Australia. By using our website or placing an order, you agree to these Terms and Conditions.
Nothing in these Terms affects your rights under Australian law, including the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (“ACL”), except where expressly excluded for commercial acquisitions as set out below.
1. Ordering and formation of contract
When you place an order through our website, you are making an offer to purchase the selected products. Our system automatically sends an order confirmation email to acknowledge receipt of your order.
A contract for the supply of products is formed only when the goods are prepared for despatch. The automatic confirmation email does not constitute acceptance.
Prior to despatch, if we identify an error in price, description, or any other issue (other than availability), we may contact you to discuss options. If the issue relates to availability, the item may be placed on backorder. If the product cannot be supplied as listed, or if no agreement is reached, the affected portion of the order will not proceed, and any payment already made for the unavailable item will be refunded.
2. Product information and suitability
We aim to ensure that all product details, specifications, and descriptions are accurate and up-to-date. Variations can occur, and manufacturers may change specifications without notice.
If a product does not match its description, your rights under the ACL apply, and you may be entitled to a repair, replacement, or refund.
FE Sports is not responsible for damage arising from incorrect installation, misuse, or installation carried out inconsistently with manufacturer guidance. We encourage customers to use qualified bicycle technicians when fitting parts, as some manufacturer warranties require this. Please review all warranty conditions before attempting installation or repair. Incorrect installation may void certain manufacturer warranties.
3. Pricing, payment, and GST
All prices on our website are in Australian Dollars (AUD) and include Goods and Services Tax (GST) at the applicable rate.
Payment can be made via Visa, Mastercard, AMEX, EFT, or approved credit terms for trade customers. Payments through our checkout are processed securely. Charges will appear on your statement as “FE SPORTS AUSTRALIA PTY LTD”.
If pricing or description errors are identified before the order is accepted, we reserve the right to correct the issue and contact you for confirmation.
If your order cannot be fulfilled after payment, items will go to backorder.
4. Availability and delivery
We strive to keep stock information accurate and despatch orders promptly. If an item is unavailable or delayed, it will go to backorder.
Orders containing multiple items may be delivered separately. Delivery timeframes are indicative; while we aim to meet them, delays can occur. You may cancel your order at any time before despatch and receive a refund. Backordered items will be shipped as soon as they arrive.
If a product is discontinued or made obsolete, we will notify you and offer an alternative if available, or provide a full refund.
5. Cancellations
Orders may be cancelled prior to despatch by contacting us using the details on our “Contact Us” page. Once an item has been despatched, the returns process outlined in Section 6 applies.
6. Returns, exchanges, and consumer rights
6.1 Commercial acquisitions
Goods supplied by FE Sports Australia may be purchased for personal, domestic, or household use, or for commercial purposes. To the extent permitted under the ACL, goods purchased for rental, hire, fleet use, or other commercial use where they are not sold to end consumers are excluded from certain statutory consumer guarantees that apply to private consumers.
6.2 Rental and hire applications
Where goods are purchased for rental or hire, whether short-term or long-term, the purchase constitutes a commercial acquisition. You are solely responsible for ensuring that such goods remain safe, maintained, and fit for purpose throughout their use. FE Sports Australia accepts no liability for any loss, damage, or claims arising from end-user misuse, failure to maintain, or improper operation during rental or hire.
6.3 Consumer purchases
Where goods are acquired for personal, domestic, or household use, your statutory rights under the ACL remain in effect. Remedies may include repair, replacement, or refund for faulty, unsafe, or misdescribed goods. Nothing in these Terms affects these statutory rights for such consumer purchases.
6.4 Warranty claims
Warranty claims are subject to the manufacturer’s warranty conditions. FE Sports Australia may, at its discretion:
Claims may be declined where goods show evidence of misuse, incorrect installation, unauthorised modification, or excessive wear beyond what would be reasonably expected for personal, domestic, or household use.
6.5 Non-warranty and discretionary returns
Non-warranty returns require prior written approval from FE Sports Australia. Returned goods must be unused, in original packaging, unregistered (where applicable), and in a condition suitable for resale as new. Restocking fees, inspection fees, handling charges, and freight costs may apply. Returns without authorisation may be refused and returned at your cost.
6.6 Risk and responsibility in returns
Risk in returned goods remains with you until the goods are received, inspected, and accepted by FE Sports Australia. You must package all goods securely and follow all return instructions issued as part of the RFC process.
7. Liability, limitation, and indemnity
7.1 Responsibility after resale, rental, or hire
Once goods leave your possession or are supplied to end users (whether through resale, rental, hire, loan, or fleet deployment), FE Sports Australia no longer has control over their use, condition, or continued safety. You are solely responsible for ensuring that goods:

7.2 Commercial purchasers
Where goods are acquired for a purpose that is wholly or predominantly related to rental, hire, fleet, gym/studio use, or other commercial activity where the goods are not sold to end consumers, certain guarantees under the Australian Consumer Law may not apply to the extent permitted by law.
To the extent allowed, FE Sports Australia excludes all implied warranties, conditions, and guarantees for such commercial acquisitions, except those which cannot legally be excluded.

These Terms are governed by the laws of Australia and the state or territory in which FE Sports Australia is headquartered. You irrevocably submit to the exclusive jurisdiction of the courts of that state or territory and any courts of appeal.
